Terms of Service
The short version
- BenDesk has a Free plan and two paid plans: Standard (CA$8.99 a month or CA$89.99 a year) and Pro (CA$18.99 a month). New accounts can try Pro free for 7 days, with no card. You're only charged if you choose to upgrade, and you can cancel any time.
- Your data is yours. Keep it accurate, and export it whenever you like.
- BenDesk helps you see your numbers; it isn't accounting, tax or legal advice.
1. Who these terms are with
These terms are an agreement between you and BENTECH, a sole proprietorship registered in Ontario (Business Identification Number 1001767036), owned and operated by Behnam Mardanian in Toronto, Ontario, Canada (“BenTech”, “we”, “us”), for your use of bentech.ca, your BenTech account, and BenDesk (together, “the service”). By creating an account or using the service, you agree to them. If you use it for a business, you agree on that business's behalf. Our Privacy Policy explains how we handle your information.
2. Your account
- You need to be at least 18, and give a real email address you can receive mail at.
- Keep your password private. You're responsible for what happens in your account; tell us right away at ben@bentech.ca if you think someone else has got in.
- One account can hold one BenDesk workspace.
- BenDesk is a tool for running a business. By using it you confirm you're using it for your business or self-employment.
3. Plans, billing and cancelling
- Plans. Free includes projects, customers and invoices. Standard adds vendors, bills and reports, for CA$8.99 a month or CA$89.99 a year. Pro adds the AI Assistant (it adds entries from one sentence and reads bills and receipts) and priority support, for CA$18.99 a month; features marked "soon" on the plans page aren't part of it yet. What each plan includes is shown on the plans page and in BenDesk under Settings → Plan & billing.
- Free trial. A new account that chooses Pro gets it free for 7 days, with no card needed. During the trial, the AI Assistant can do a fifth of the tasks a paid Pro plan includes each month. When the trial ends, the account moves to Free unless you've upgraded. If you upgrade during the trial, your first charge happens when the trial would have ended.
- Payment. Paid plans are billed in advance, monthly or yearly, in Canadian dollars, through our payment processor, Stripe. We never see or store your full card number. BenTech isn't registered for GST/HST, so no sales tax is added; if that changes, we'll tell you before it applies.
- Renewal. A paid plan renews automatically at the end of each month or year until you cancel. We'll give you at least 30 days' notice by email before any price change applies to you.
- Cancelling. You can cancel any time in BenDesk (Settings → Plan & billing → Manage billing). You keep the plan until the end of the period you've paid for. After that, the account moves to Free.
- Refunds. Payments aren't refunded for partly used periods. If you were charged by mistake, for example a renewal you meant to cancel, email ben@bentech.ca within 14 days of the charge and we'll refund it.
- Moving to Free keeps your data. Nothing you entered is deleted when you cancel or a trial ends. Parts of BenDesk that aren't in your plan simply can't be opened until you upgrade again.
- Failed payments. If a payment fails, Stripe tries again over the following days. If it still can't be collected, the account moves to Free.
BenDesk is improving quickly, and features may change, be added or be removed. We won't remove a feature from a plan you've paid for during the period you've paid for.
4. Your data
- It's yours. You own everything you put into BenDesk. You give us permission to store and process it only so we can provide the service to you.
- Keep it accurate and lawful. You're responsible for the information you enter — including your customers' details — and for having the right to store it.
- Keep your own copies of what matters. We back up the service every day, but you can export your data at any time (Settings → Export to Excel), and we recommend you do so regularly.
5. What BenDesk is — and isn't
BenDesk calculates margins, profit, budgets, forecasts and invoices from the numbers you enter. It's a tool to help you understand your business. It is not accounting, bookkeeping, tax or legal advice, and it doesn't replace an accountant. You're responsible for your own tax filings, the tax you charge on invoices (such as GST/HST), and the invoices you send.
Ben, the AI assistant, and “Scan a bill” (Pro)
- Ben is an AI. Ben is BenDesk's AI assistant, not a person. Messages you send to ben@bentech.ca go to a person.
- It suggests; you decide. The assistant reads what you type or attach and proposes entries — a cost, hours, a bill, an invoice. Nothing is saved until you check it and tap Confirm. AI can misread a receipt or misunderstand a request, so check every amount, date, tax and project before you confirm. You're responsible for what you confirm.
- Its answers come from your data. When you ask about your numbers, Ben answers from what's in BenDesk. It can still get one wrong, so check the figures in the app before you rely on them, for example for a tax filing.
- It isn't advice. Like the rest of BenDesk, it isn't accounting, tax or legal advice.
- What it sees. To do the job, what you send and the parts of your BenDesk data it needs are processed by our AI provider, as described in the Privacy Policy. Only attach documents you have the right to share.
- Fair use. Each workspace can run a set number of AI tasks a month, shown in the app. We may limit use that looks automated or abusive.
6. Acceptable use
Don't use the service to break the law, send spam, store content you have no right to, try to get into other people's accounts or data, probe or overload our systems, or copy or resell the service. We may suspend or close an account that does, and we'll tell you why unless the law or safety stops us.
7. Our part
We work to keep the service secure, available and backed up, and to fix problems quickly. But it's provided “as is” and “as available” — we can't promise it will always be uninterrupted or error-free.
8. Liability
To the extent the law allows, we aren't liable for indirect or consequential losses — such as lost profits, lost business or lost data — arising from your use of the service. Our total liability to you for any claim is limited to the greater of what you paid us in the 12 months before the claim, or CA$100. Nothing in these terms limits liability that can't be limited by law.
You agree to cover our reasonable losses and costs, including legal fees, if someone makes a claim against us because of information you put into BenDesk, or because you used the service in breach of these terms or the law.
9. Ending the agreement
You can stop at any time by deleting your account (in BenDesk, Your account → Delete my account), which removes your data as described in the Privacy Policy and cancels any paid plan straight away. If we ever discontinue BenDesk, we'll give you at least 30 days' notice by email so you can export your data.
10. Changes
We may update these terms as the service grows. We'll change the date at the top, and for significant changes we'll email account holders before they take effect. If you keep using the service after that, the new terms apply; if you don't agree, you can delete your account.
11. Law
These terms are governed by the laws of Ontario and the federal laws of Canada that apply there. Any dispute will be handled by the courts of Ontario.
